If you are a California resident, please read the Privacy Policy for California Residents in compliance with the California Consumer Privacy Act of 2018 (CCPA).
Harry Winston knows that your privacy is important to you, and we want you to know that it is important to us too. We created this Privacy Policy (“Privacy Policy”) to explain the types of information we collect through our Web sites (on which it is linked to in the footer) and the various social networking platforms that we use (each, a “Website”). This Privacy Policy does not apply to information that we collect offline, such as in our retail salons. This Privacy Policy describes how we will use, disclose and protect this information once it is collected, and how you can opt-out of some of our uses of your information.
Here are a few general principles to keep in mind as you read through this Privacy Policy:
- The Website is owned and operated by Harry Winston, Inc. and its corporate affiliates (referred to collectively in this Privacy Policy as “we”, “us”, “our” and other similar pronouns).
- “California’s Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. Alternatively, businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties' direct marketing purposes unless the customer has opted-in to such information sharing. Accordingly, we will not share your personal information with third parties other than our affiliates for the third party’s own marketing purposes unless you opt-in, for example by checking a consent check box when providing us with your information. We will, however, share your personal information with our affiliates for marketing purposes. To request a list of the affiliates with whom we have shared your personal information for marketing purposes in the last year, write to us at Harry Winston, 718 Fifth Avenue, New York, NY 10019 and include the words “California Shine The Light Request” in the “Regarding” line.
- As our business evolves, this Privacy Policy may change, so check back to this page periodically to make sure you understand how your personal information will be treated.
- This Privacy Policy is incorporated into, and part of, our Terms of Use, which govern your use of our Websites as a whole.
- If you are located outside of the United States, you should know that the information you provide to us is being transmitted to us and processed in the United States and will be protected subject to this Privacy Policy and United States laws, which may not be as protective as the laws in your country. Also, this Website places cookies and local shared objects on your computer or device which are further described below.

What information is collected on this Website?

We collect Personal Information such as your name; employer name; day and month of birth; postal addresses; e-mail addresses; telephone numbers; fax numbers; photograph; gender; Website browsing and transaction history; job history and application information; and interests, hobbies and demographic information. For example, we collect Personal Information when you sign up to receive emails from us; request a catalog; request a sales associate to contact you; schedule a visit to our salon; create a wish list on our Website; sign up for our newsletters; enter sweepstakes and contests; complete surveys; contribute to a chat room, bulletin board, blog or other social forum on the Website; or submit a comment or question to us using a “contact us” or similar feature on the Website.
A “tell-a-friend” tool provided on the Website and/or in our e-mails allows you to send information about our products and offerings to another person. You may also be able to purchase gifts for another person on our Website. When you use these offerings, we ask you for the name and contact information of the other person, and that information will be protected pursuant to this Privacy Policy. We will not use the other person’s information for additional purposes without their consent.
Website Usage Information
As is the case with many websites, our servers automatically collect your IP address when you visit our Website, and we may associate that with your domain name or that of your Internet access provider. We may also capture certain “clickstream data” pertaining to your Website usage. Clickstream data includes, for example, information about your computer or device, Web browser and operating system and their settings, the referring page that linked you to the Website, the pages, content or ads you see or click on during your visit and when and for how long you do so, items you download, the next website you visit when you leave the Website, and any search terms you have entered on the Website or a referral site.
In addition, we may deploy various tracking technologies on the Website to collect additional information about your Website visits. For example:
- Cookies are small data files stored on your computer or device at the request of a website. A cookie assigns a unique numerical identifier to your Web browser, and may enable us to recognize you as the same user who was at our Website in the past, and relate your use of the Website to other information about you, such as your Website usage information and Personal Information. Cookies may also be used to enhance your experience on the Website (for example, by storing your username so you can log in easily, keeping you logged into the Website after you have provided your password, and storing the contents of your shopping cart as you browse) or to collect general usage and aggregated statistical information and detect and prevent fraud. Most browsers can be set to detect cookies and give you an opportunity to reject them, but refusing cookies may, in some cases, inhibit or preclude your use of the Website or its features. To learn more about the use of cookies, including how to manage or delete them, please visit https://www.allaboutcookies.org/.
- HTML5 (the language some websites are coded in) may be used to store information on your computer or device about your Website usage activities. This information can be retrieved by us to determine how our Website is being used by our visitors, how it can be improved, and to customize it for our users.
- A pixel tag (also known as a “clear GIF” or “web beacon”) is a tiny image – typically just one-pixel – that can be placed on a Web page or in our electronic communications to you in order to help us measure the effectiveness of our content by, for example, counting the number of individuals who visit us online or verifying whether you’ve opened one of our emails or seen one of our Web pages.
These tracking technologies may be deployed by us and/or by our service providers or partners on our behalf. These technologies enable us to assign a unique number to you, and relate your Website Usage Information to other information about you, including your Personal Information.
Do Not Track Disclosures
This Website does not process Do-Not-Track headers transmitted by Web browsers. Our third party web analytics companies collect information about your online activities over time. Interest Based Advertising and Website Analytics
We may collect information about your online activities on our Website to provide you with advertising about products and services tailored to your individual interests. We also may obtain information for this purpose from third-party websites on which our ads are served. This section of our Privacy Policy provides details and explains how to exercise your choices.
You may see certain ads on other websites because we work with advertising partners (including advertising networks) to engage in remarketing and retargeting activities. Our advertising partners allow us to target our messaging to users through demographic, interest-based and contextual means. These partners track your online activities over time and across websites by collecting information through automated means, including through the use of third-party cookies, web server logs, and web beacons. They use this information to show you advertisements that may be tailored to your individual interests. The information our advertising partners may collect includes data about your visits to websites that participate in the relevant advertising networks, such as the pages or advertisements you view and the actions you take on the websites. This data collection takes place both on our website and on third-party websites that participate in the ad networks. This process also helps us track the effectiveness of our marketing efforts. For example, we utilize certain of our ad partners’ targeted advertising services to show you our ads on other websites based on your prior visits to our website and other online activity. Below is a chart that lists our current advertising partners that provide these features together with corresponding links to describe how you may opt out of them. Opting-out does not mean that you will stop receiving ads from us. It means that you still stop receiving ads from us that have been targeted to you based on your visits and browsing activity across websites over time.

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
Access to Specific Information and Data Portability Rights
You have the right to request that the Company disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request we will disclose to you:
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting that personal information.
- The categories of third parties with whom we share that personal information.
- The specific pieces of personal information we collected about you (also called a data portability request).
Deletion Request Rights
You have the right to request that the Company delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:
- Calling us at: +1 800 988 4110
- Emailing us at: clientcare@harrywinston.com
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
Making a verifiable consumer request does not require you to create an account with us.
We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
Response Timing and Format
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
